Complaint routes and remedies

Organise the facts and seek an appropriate remedy from the identified business; seller contact can help resolve a dispute but this guide does not make it a universal mandatory prerequisite for every Commission complaint. The National Consumer Helpline (NCH) is a pre-litigation grievance channel, not a Consumer Commission judgment. e-Jagriti is the official platform for Commission processes. Banaka does not send your draft to either service, issue a case number or accept evidence uploads.

Section 35 describes who may make a complaint. Jurisdiction has both value and territorial questions. The 2021 jurisdiction rules prescribe ordinary complaint value bands using the price paid as consideration: District up to ₹50 lakh, State above ₹50 lakh up to ₹2 crore, National above ₹2 crore, subject to the Act. Do not substitute the compensation you hope to receive for that basis, or apply these bands mechanically to unfair-contract complaints, appeals or other distinct proceedings. Sections 34, 47 and 58 contain separate provisions and printed Act figures; read the applicable rules alongside them.

Section 69 generally requires filing within two years from the date the cause of action arose, with a reasoned delay-condonation provision for sufficient cause. That date can be disputed. An ongoing support conversation or NCH grievance should not be assumed to pause or restart the limitation period. Section 37 deals with reference to mediation under its conditions; not every dispute must settle and not every NCH interaction is statutory mediation. Verify the filing requirements, fees, forum and limitation on official channels or with suitable legal help.
