Registration and ownership transfer

Other language: हिंदी

Understand registration, transfer reporting and transport-vehicle fitness as distinct requirements.

Section 39 generally prohibits driving, or permitting a vehicle to be driven, in a public place or any other place unless it is registered and its registration mark is displayed as prescribed, subject to the statutory proviso. Sections 40 and 41 address the registering authority and process. Registration records the vehicle; it does not replace the driver's licence, required insurance or a transport permit.

Section 50 imposes reporting duties on both transferor and transferee. Its timing and supporting documents differ for same-State transfers, transfers involving another State, death of an owner and public auction. Read the relevant subsection rather than using one deadline for every transfer. Section 56 separately concerns certificates of fitness for transport vehicles; other vehicle requirements may arise under applicable rules. Complete transactions through the competent transport authority, not Banaka.

Fictional example

Fictional example: Arjun buys a used car and keeps only the seller's receipt. The receipt does not itself complete the reporting and registration-record steps in section 50.

What not to assume

Do not submit registration numbers, identity documents or sale records here. State tax and service requirements are not a single nationwide checklist.
