Distinguish the involved driver's duties from protections for a voluntary helper.

Section 134 concerns the driver or other person in charge when an accident injures someone or damages third-party property. It requires reasonable steps to secure medical attention, subject to the stated circumstances, information to police, and written information to the insurer. Where no police officer is present, it says report at the nearest police station as soon as possible and in any case within twenty-four hours. This reporting limit is not a reason to delay urgent medical help.

Section 134A defines a Good Samaritan as a person who in good faith, voluntarily and without expectation of reward or compensation gives emergency assistance at an accident scene or transports the victim to hospital. Its protection concerns the specified injury or death resulting from negligence while giving or failing to give that assistance. It is not immunity for every unrelated act and does not erase the involved driver's duties. Rules separately deal with questioning and disclosure of helper information. In an actual emergency, seek emergency services rather than trying to decide liability from this guide.

Fictional example

Fictional example: a passer-by voluntarily helps an injured road user without expecting payment. Their role under section 134A differs from that of the driver involved in the collision under section 134.
