Poor services and deficiency

Compare the promised service with the actual performance and document the specific failure.

Section 2(11) defines deficiency by a fault, imperfection, shortcoming or inadequacy in the quality, nature or manner of performance required by law or undertaken by the provider. It includes specified negligent acts or omissions causing loss or injury, and deliberate withholding of relevant information. An unpleasant experience alone does not answer the legal question: identify the service term, what the provider did or failed to do, and the supporting evidence.

Keep the agreement, payment record, scheduled work, service reports and correspondence. Section 39 provides specified Commission remedies, including removal of deficiency and other relief when established. Some services are regulated by specialist authorities or involve legal questions about consumer status and contractual duties. A provider's internal escalation and sector regulator may be relevant, but their existence does not mean every route has identical powers or that a complaint automatically succeeds.

Fictional example

Fictional example: a paid repair service promises to replace a specified part but returns the device without doing that work. The customer compares the work order, invoice and service report rather than making an unsupported allegation that every employee was dishonest.
