Temporary injunctions and interim relief

Distinguish temporary protection during a case from the final decision.

Section 94 provides for supplemental proceedings to prevent the ends of justice from being defeated, where prescribed. Its references include temporary injunctions and receivers. Order XXXIX supplies rules for temporary injunctions; the availability of a power is not a promise that every application will succeed.

Order XXXIX Rules 1 and 2 address different situations for temporary restraint. Such an order does not itself finally determine ownership or all rights in the dispute. Read the grounds, terms and duration of the actual court order rather than assuming a universal 'stay' applies to everything.

Rule 3 starts with notice to the opposite party, subject to the stated exception where delay would defeat the object. If notice is dispensed with, the court must record reasons and the applicant must comply with the specified delivery and affidavit requirements. The 2025 amendment changes the postal-service wording; our reader records that change.

Fictional example

Fictional example: a disputed property may be at risk of disposal while the suit is pending. A request for temporary protection is different from a final declaration of title. This example predicts neither eligibility nor an outcome.

What not to assume

Do not infer an automatic injunction, automatic stay or permission to ignore an order. Court orders and special statutes require separate reading.
