Investigation approval versus prosecution sanction

Sections 17A and 19 operate at different stages and have different conditions.

Section 17 identifies officers authorised to investigate. Section 17A addresses prior approval for enquiry, inquiry or investigation where the alleged offence relates to a recommendation or decision in discharge of official functions or duties. It expressly excepts specified on-the-spot arrest cases involving accepting or attempting to accept an undue advantage. Do not describe it as approval for every investigation without qualification.

Section 19 instead restricts a court's taking cognizance of specified offences without the required previous sanction, subject to the Act's wording and exceptions. It includes former public servants in the circumstances described and contains procedures for sanction requests. The approving authority and procedural stage must be identified separately; investigation approval is not itself prosecution sanction or a finding of guilt.
