Cheque-bounce documents and evidence checklist

Organise the cheque, bank memo, liability records, demand notice, service evidence and payment timeline. Understand sections 145 and 146.
Build a factual record around the legal questions, not just a folder of screenshots. Preserve the cheque and bank return memo, transaction records explaining the asserted debt, the written demand, dispatch/service records and evidence of any payments. Keep an index identifying which document supports which event. Copies used for preparation should not replace originals or the form of evidence required in the proceeding.
Section 146 directs the court, on production of the bank slip or memo bearing the official mark denoting dishonour, to presume dishonour unless and until disproved. Its subject is dishonour; the memo does not itself prove notice receipt, every debt assertion or every procedural condition. Section 145 allows the complainant's evidence on affidavit subject to its terms and provides for examination of the person giving affidavit as specified.
For a company-related transaction, section 141 raises additional questions about the company, the person's role, responsibility and the relevant time. Do not substitute a list of every employee for those statutory conditions. Digital records also raise evidentiary requirements outside the NI Act; read the applicable evidence law, including the electronic-record provisions and procedural context, rather than assuming a cropped screenshot is self-proving.
Worked example
Illustration: a bank memo supports the return event, a postal record supports dispatch, and an acknowledgement may support receipt. An invoice supports the asserted transaction. Labelling each document's role makes gaps visible; combining all four into one 'cheque-bounce proof' label hides those gaps.
