Section 7 concerns a public servant obtaining, accepting or attempting to obtain an undue advantage in the circumstances it specifies. Its explanation and illustration show why processing a routine application on time does not make an unofficial demand legitimate. Section 7A separately addresses taking an undue advantage to influence a public servant by corrupt or illegal means or personal influence.

Section 8 addresses giving or promising an undue advantage with the specified intention. Its compulsion provisos include reporting to a law-enforcement authority or investigating agency within seven days from giving the advantage. Subsection (2) separately covers assistance to an investigation after informing the agency. These are conditional provisions, not blanket immunity for anyone who later describes a payment as forced.

Fictional example: an intermediary asks for a personal benefit to influence an official. Read section 7A instead of assuming only the official who eventually acts could face an allegation.
