Legal heir certificate vs succession certificate: which document does what?

Compare the purpose, issuing authority and limits of inheritance certificates, with examples for a bank balance, family records and disputed property.

The short answer

A legal heir certificate generally identifies the deceased person’s heirs for an administrative purpose under the relevant state procedure. A succession certificate under Part X of the Indian Succession Act is a court certificate concerning specified debts and securities. They are not automatically interchangeable.

First ask the bank, employer or public authority which document its applicable process accepts, and for which asset. A familiar document name alone does not establish that it meets that requirement.

Legal heir certificates follow local rules

Names such as legal heirship, surviving-member and family-membership certificate can refer to different state services. Check the issuing authority, eligible applicants, required documents and purpose on the relevant government portal. There is no single nationwide application form, fee or promised processing period for all these services.

For example, Kerala Revenue describes legal heirship certification by the Tahsildar after enquiry through the Village Officer, and separately describes family-membership certification. This is a state example, not a procedure to apply everywhere.

What the court certificate covers

Part X concerns debts and securities, not a blanket declaration of ownership of every asset left by the deceased. Section 372 requires an application identifying the relevant debts and securities and the basis of the applicant’s claim. Section 374 concerns the contents and powers granted by the certificate.

Section 371 sets the District Judge’s jurisdiction by the deceased’s ordinary residence at death, or, if there was no fixed residence, by property within the jurisdiction. Section 388 provides for investing inferior courts with these powers; check the competent local court and applicable state provisions.

Collection authority is not final inheritance title

Section 381 protects specified good-faith payments or dealings with the certificate holder in relation to the debts and securities it covers. Section 387 leaves substantive rights open to determination in a suit or other proceeding, and the holder can remain accountable to the person lawfully entitled.

Do not assume that one person holding a certificate owns the entire estate or excludes other heirs. A will, probate or letters of administration can raise separate questions. Land-title disputes and inheritance shares need their own legal analysis.

Examples

A bank balance and a family house

Meera’s father leaves a deposit and a house. Before seeking a certificate, she checks the bank’s deceased-account process, nomination or joint-holding facts and the documents accepted. If a Part X certificate is needed, the deposit debt is a different question from ownership and mutation of the house. The certificate should not be used to claim that both assets now belong solely to Meera.

Before paying an application fee

List each asset, its institution, any will and known heirs. Ask for the institution’s written requirements. Then check the relevant state certificate service or court process. Keep disputed entitlement separate from routine record updates; do not buy a generic form on the assumption it works nationwide.

Common questions

Is a succession certificate compulsory for every bank claim?
Do not assume so. Check the account facts and the bank’s applicable deceased-claim process. This guide does not prescribe one document for every bank, balance or nomination situation.
Does the comparison apply only to Hindu families?
